Preface

This privacy statement applies to the processing of personal data by Watersley Sports & Talent Park, Chamber of Commerce number 61418730 as “controller”, hereinafter referred to as Watersley or “we / our”. In case you purchase our products or services, we will process your personal data. We do this to provide you with the best possible service and to achieve sustainable cooperation. In this statement, we explain for what purpose and in what way we process your data and how you can exercise control over this.

We have appointed a Data Protection Officer to serve you as a valuable contact of Watersley. You can find the contact details at the bottom of this privacy statement.

What personal data do we process?

Personal data is all data that provides information about you as an identifiable person, they tell something about who you are. We “process” this data when we store, view, share, send and delete it. When you enter into an agreement with Watersley and/or register for our mailing list, request prices, and information through our site or by telephone, we ask you to enter company details and/or contact details.

In addition to information that you enter on our website or give on the phone, we can also combine this with previously obtained data if you have permitted for this. It is therefore actually all information that we can relate to you, including indirectly.

The concrete personal data that we process are:

  • Name, address, place of residence
  • Telephone number
  • Email address, opt-in for mailings
  • Date of birth
  • Business information & job description
  • Contact history
  • Invoice and payment information

We do not process special personal data such as your creed, race, political or sexual preference, criminal data, religion, union membership or biometric/genetic or medical background without your express consent.

Why do we process that personal data?

Our goal is to provide services to you so, first of all, we use your data to communicate and identify. This means that we use this data for the execution of the agreement that you conclude with us, such as the processing of financial data when you pay for a service, the creation and maintenance of an account, or in case you have a question about the service we provide and we must call you back or contact you by email. The legal basis for this is Article 6, paragraph 1, sub b of the General Data Protection Regulation “GDPR”.

Besides, we will also use your data in the context of marketing activities if we think that this may be relevant to you as our customer. Think of offers and advertisements on the interests we know about you or for participating in research and surveys. But also for sending newsletters and social media. The basis for this is Article 6 paragraph 1 sub f GDPR.

Finally, we may have to process personal data in the context of our legal obligations because the law requires us to do so. For example, we will at least process financial data for our accounting obligations. The basis for this is Article 6 paragraph 1 sub c GDPR.

Newsletters

We may send you newsletters by email about the services you already purchase. In case we want to approach you about other products or services, we request that you first give your permission for this. This permission can always be withdrawn by choosing an “opt-out” at the bottom of the newsletter. Your email address will then be on a separate list so that we know that you do not want to be contacted by email.

Mandatory Provision

When we ask you for personal data, we will state per situation whether the provision of the data is necessary or mandatory and what the (possible) consequences are if the data are not provided. The starting point is always that Watersley will not process more personal data than necessary for the purposes described above.

Exchange with third parties

We never provide, sell, rent or lease your data to third parties, unless we are legally obliged to provide data or if you have given permission for this. We engage service providers for the execution of our services. These are not “third party recipients” but “processors”. These processors do not use the data for their purposes and only process the personal data under the order of Watersley.

The external processors we use are:

  • Dropbox: Dropbox is a cloud service for online file storage. The user can synchronize files with it with different computers and mobile devices.
  • Mailchimp: Email marketing software in which personal data is stored and personal mailings are sent.
  • Reeleezee: Online accounting program in which our financial administration is processed.
  • Office 365: Subscription service for Microsoft tools such as email accounts and digital calendars.
  • iZettle: The personal data sent to iZettle which is required for payment processing.

Data outside the European economic area

Your data can be processed by us, or by the service providers we work with outside the EEA. This is currently happening in the United States. The main rule is that an organization may only transfer personal data to third countries with an adequate level of protection. The European Commission has agreed on separate security measures for this country, which guarantees the security of your data.

Automated decision-making and profiling

Watersley does not use automated decision-making and/or profiling.

Secure and store

We take appropriate security measures to limit abuse of and unauthorized access to your data.

  • Information and inspection: You can see which personal data we process about you. We would be happy to tell you more about how and why we process this data if desired.
  • Rectification: Are the data we have about you incorrect? Let us know and we will adjust it.
  • Oblivion: You can have the personal data that we hold about you removed. We may still have to process that data for other purposes, such as administration or financial settlement.
  • Restriction: If you feel that we are processing your data unlawfully or incorrectly, you can also have that processing limited.
  • Objection (objection): you can object to the processing of your data.
  • Data portability: This gives you the right to effortlessly receive the personal data we have from you. This only applies to digital data.

Besides, you can also:

  • Withdraw consent: for example, for receiving mailings. If you want to withdraw consent for another processing, you can contact us.

We ensure that only the necessary persons have access to the data, that access to the data is protected, and that our security measures are regularly checked.

We do not store your data longer than necessary for one of the purposes we have described. The retention periods may vary by law, but you can assume that after 2 years after the last contact between you and Watersley, we will delete all personal data that we no longer need to process. In consultation, we can opt for anonymization instead of deleting if this is necessary for our statistics, for example.

Rights you can exercise

If we process personal data about you, you have the right to control this as part of your privacy. What rights do you have?

Whatever your request, contact us and we will help you free of charge. For this, you can contact us via the contact details below. Please note that sometimes we cannot comply with your request because the processing of personal data is necessary by us. For example, if we have not yet completed the agreement, or if we are required by national law to keep financial data. If this is the case, the burden of proof lies with Watersley and we will explain this to you. In the event of withdrawing consent or objecting to direct marketing, we will always grant this request.

Finally, we would like to make it clear to you that we, as a so-called “controller”, must identify the person making the request and that we can, therefore, request further information. In any case, we respond to any request within 4 weeks.

Third-party websites

This statement does not apply to third-party websites that are linked to the Watersley website through links. We cannot guarantee that these websites handle your data reliably or securely. Always read the privacy statement before using the relevant website.

Amendments

Watersley reserves the right to update this statement from time to time. Any changes will be made on our website. Watersley may process your data for new purposes that have not yet been disclosed to you. In that case, we will contact you before using your data for these new purposes, to inform you of the changes to the protection of personal data and to offer you the opportunity to refuse.
